White House officials may have finally run out of ways to avoid testifying about the fired U.S. Attorneys scandal. District Court Judge Patrick Bates denied a Justice Dept. request to put a hold on his rulingbarring executive branch employees from using executive privilege to skirt testifying before Congress.
The district court’s July 31 rulingcompells Harriet Miers, the former top White House counsel, to honor a House Judiciary Committee subpoena to give sworn, public testimony. The judiciary committee has for more than a year demanded Miers discuss White House involvement about the dismissal of nine U.S. Attorneys. The committee has also subpoenaed documents from White House Chief of Staff Joshua Bolten on the attorney firings.
Bates action could also effect more than Miers and Bolten– Karl Rove, Attorney General Michael Mukasey, and EPA head Stephen Johnson have also refused to testify before Congress on executive privilege grounds.
