			<content:encoded><![CDATA[<p>Al Franken, soon to be the junior senator from Minnesota, is no stranger to controversy after spending the last eight months fighting Sen. Norm Coleman (R-Minn.) over the results of last November&#8217;s election. But if Franken thinks he&#8217;ll find things any more restful in Washington, he should think again.</p>
<p>That&#8217;s because the soon-to-be-sworn-in freshman is slated to take seats on both the Senate Judiciary and the Health, Education, Labor and Pensions Committees &#8212; the two panels that just happen to be on the front lines of the Democrats&#8217; priorities for the rest of the year.<span id="more-49306"></span></p>
<p>First, there&#8217;s the thorny debate over health care reform, which the HELP committee has already officially begun &#8212; but which also remains a long way from over. Then there&#8217;s the process to seat Sonia Sotomayor on the Supreme Court, which will launch in the Judiciary panel. And finally, there&#8217;s the ideologically charged battle over the labor-friendly Employee Free Choice Act, a fight set to begin this summer in the HELP Committee.</p>
<p>Franken will also sit on the Special Committee on Aging and the Indian Affairs panel.</p>

Van Dongen praised Coleman&#8217;s &#8220;guts&#8221; for seeing through the state legal process and said he had &#8220;no regrets&#8221; about his fundraising.</p>
<p>&#8220;Every Senate seat is important,&#8221; said Van Dongen. &#8220;When you think of the amount of money involved in the recount and the subsequent proceedings &#8212; whatever it was, $2 million, $3 million, $4 million &#8212; that&#8217;s the smallest amount you&#8217;ll see spent on a Senate seat anywhere in the country, in any state.&#8221;</p>
<p><span id="more-49288"></span>Van Dongen would have been ready to raise funds for more Coleman challenges &#8212; &#8220;I think there would have been a broad base of support&#8221; &#8212; but he supported the decision. &#8220;It&#8217;s his decision to make. From our perspective it&#8217;s a loss to the U.S. Senate and a loss to the free enterprise cause, and I hope to see him in public life again.&#8221;</p>

John Cornyn (R-Texas) have said about the possibility of today decision by the Minnesota Supreme Court. Back in March, Pawlenty speculated that Coleman might exhaust his appeals by autumn, suggesting a Supreme Court challenge. Cornyn said last week that he would support Coleman if he went that route. In the face of all of that, Coleman can look like he left the race gracefully despite the historic seven-month delay.</p>

<p>But what&#8217;s the &#8220;green light?&#8221; <span id="more-49025"></span>If the court rules for Democrat Al Franken but doesn&#8217;t specifically order the governor to sign a certificate? Will he? Signs point to no; he suggests that he&#8217;d abide by a stay if one was issued by a higher court. And there would be considerable pressure on Pawlenty to wait for former GOP Sen. Norm Coleman&#8217;s next move even if the state Supreme Court ordered the signing of a certificate; that action could, theoretically, be stayed. (Obviously, there is no precedent for a senator being certified and then being pulled out of the body while a higher court re-evaluates his election. If Franken is certified, he will be a senator.)</p>

			<content:encoded><![CDATA[<p>Three election law experts who have been closely tracking the Norm Coleman-Al Franken contest for Minnesota&#8217;s currently unfilled seat in the U.S. Senate weigh in today with written reactions to the final order (<a href="http://dl-client.getdropbox.com/u/60825/COLEMANvFRANKENfinalfindingsoffact.pdf">pdf</a>) from the three-judge panel that heard Coleman’s complaint. All admired the order for its unanimity and deft handling of Coleman’s equal protection claims.<span id="more-38638"></span></p>
<p><a href="http://minnesotaindependent.com/27550/coleman-franken-court-resolution-scenarios">The ruling meets two standards</a> that Ohio State University professor Edward Foley had set for the panel: unanimity and a willingness to grapple with whether local variations in applying state election processes violated Minnesotans’ constitutional guarantee of equal protection under the law.</p>
<p><a href="http://moritzlaw.osu.edu/electionlaw/comments/articles.php?ID=5797">Foley</a> stresses the impartiality of the ruling — as compared to, say, Bush v. Gore in 2000, on which Coleman’s claim of equal protection violations relied:</p>
<blockquote><p>There is no doubt … that this three-judge court would have rejected the same Equal Protection claim if raised by Franken rather than Coleman.</p></blockquote>
<p><a href="http://electionlawblog.org/">Loyola Law School professor Rich Hasen</a> doesn’t use the word “impartial” but he does call the ruling “careful, unanimous,” “reasonable and conservative,” and  ”detailed and measured.”</p>
<p>On equal protection, Hasen writes that the three-judge panel “has it both ways” — calling the issue outside the court’s scope but also rejecting it with “impressive and sensitive handling”:</p>
<blockquote><p>As I predicted, they rejected a reading of the case that would require the counting of further illegal votes to deal with any illegal votes that had already been cast, and they rejected an argument that any lack of perfection in the casting and counting of votes constitutes a violation of equal protection.</p></blockquote>
<p>Coleman’s equal protection argument is “not trivial,” writes <a href="http://www.startribune.com/opinion/commentary/42932642.html">Guy Charles, a University of Minnesota law professor</a> temporarily teaching at Duke University:</p>
<blockquote><p>But as judges and legal academics like to say, that argument proves too much … Unfortunately for Coleman, his prospects always depended upon a miracle. He wanted before and wants now more ballots to be counted. But the more ballots that are counted — by election officials, the Canvassing Board and the trial court — the better Al Franken does.</p></blockquote>
<p>“It’s over,” Charles advises Coleman on his post-election legal battle. “It’s Kumbaya time.”</p>

<blockquote><p>&#8220;I proudly stand in support of Senator Norm Coleman&#8217;s pursuit to see that Minnesota&#8217;s voters are enfranchised by having their ballots counted.  If voters do not have confidence in elections, then they will not have confidence in their elected leaders.  That is why the judges&#8217; review of thousands of additional ballots in Minnesota is critical to the democratic process.  The Republican National Committee remains committed to Norm Coleman&#8217;s campaign and confident that when the recount contest is complete, he will be re-elected to the U.S. Senate.&#8221;<span id="more-29131"></span></p></blockquote>
<p>Meanwhile, Franken&#8217;s lawyers are arguing before the Minnesota Supreme Court today that Franken should be issued a <a href="http://minnesotaindependent.com/25433/bill-to-seat-franken-could-put-pawlenty-in-a-pickle-kahn-says">temporary election certificate</a> so that Minnesota can have its full representation in the Senate while Coleman&#8217;s election contest is resolved (<a href="http://minnesotaindependent.com/25492/david-schultz-unless-franken-gets-temporary-certificate-senate-seat-could-stay-empty-5-months">it could take a while</a>). <p>A Coleman spokesman insists that the move is purely financial and reflects no sense of pessimism about the race.</p>
<p>“The senator needs to earn a living while the contest is going on,” said Mark Drake, adding, &#8220;I think our supporters recognize that Sen. Coleman is not a millionaire.&#8221;<span id="more-26774"></span></p>
<p>Meanwhile, Coleman&#8217;s opponent, <a href="http://washingtonindependent.com/24910/whats-with-this-dfl-thing-a-brief-minnesota-history-lesson">DFLer</a> Al Franken, is getting ready for work at the Capitol. According to our sister site, <a href="http://minnesotaindependent.com/24053/seat-franken">The Minnesota Independent</a>, Franken discussed Senate business and potential committee appointments with Majority Leader Harry Reid (D-Nev.), and Reid has indicated that he would like to seat Franken as soon as possible.</p>
<p>But in all likelihood, they&#8217;ll have to wait for a ruling from a specially appointed three-judge panel, which will begin hearing Coleman&#8217;s election contest on Monday.</p>
