DREAM Act and Don’t Ask, Don’t Tell Repeal Derail Defense Bill Vote

Senate Republicans filibustered the defense authorization bill Tuesday afternoon, ending a push by Senate Majority Leader Harry Reid (D-Nev.) to pass the DREAM Act, which would provide legal status to some undocumented immigrants in exchange for school or military service, and a repeal of Don’t Ask, Don’t Tell as amendments to the legislation.

The defense authorization bill has been passed for the past 48 consecutive years. It failed to move to the Senate floor today in a 56-43 vote, with no “yea” votes by Republicans.

The main argument marshaled against continuing with the defense bill was that both a Don’t Ask, Don’t Tell repeal and the DREAM Act have too little relevance to defense. But both proposals have major implications for those who serve — or wish to serve — in the military. A repeal of Don’t Ask, Don’t Tell would allow gays and lesbians to serve openly, without fear their sexual orientation would lead to discharge from the military. The DREAM Act would allow illegal immigrants who came to the U.S. as children to earn legal status by serving in the military or attending two years of college, providing what many have said would be a needed boost for military recruitment.

After the filibuster, Reid said he will continue to push for the DREAM Act, which was originally proposed in 2001 by Sen. Orrin Hatch (R-Utah) — who voted against bringing the defense authorization bill to the floor today. The DREAM Act has come up several times since 2001 but only went to a vote as a standalone bill once, in 2007. Although he did not specify a timeline, Reid said today the act is not dead.

“We’re going to vote on the DREAM Act, it’s just a question of when,” Reid said after the filibuster. “This isn’t the end of this. We’re going to continue to move on.”

The vote was a major disappointment to immigration reform advocates and GLBT rights supporters. Rea Carey, executive director of the National Gay and Lesbian Task Force, said in a statement the senators “who led and supported the filibuster effort should be ashamed.”

Mary Giovagnoli, director of Immigration Policy Center, told TWI the vote showed “a lack of leadership” by Republican senators. “This was clearly putting procedural wrangling and partisan politics over social issues that are clearly something the American public wants action on,” she said.

Democrats needed at least one Republican to vote to move forward with the bill to stop a Republican filibuster. But procedural squabbles deterred Republicans from voting for the legislation, arguing that Reid was denying them the chance to amend the bill.

Reid previously said he would allow only three amendments: a repeal of Don’t Ask, Don’t Tell; the DREAM Act; and an amendment to ban the practice of placing “secret holds” on presidential nominees.

Sen. Carl Levin (D-Mich.), chairman of the Senate Armed Services Committee, repeatedly quoted a floor statement by Reid last Thursday, when Reid said he was “willing to work with Republicans on a process that will permit the Senate to consider these matters and complete the bill as soon as possible.”

But Republicans argued the short timetable before a pre-election recess would prevent them from adding enough amendments. Two moderate Republicans who Democrat leaders hoped would vote for moving forward with the bill, Maine Sens. Susan Collins and Olympia Snowe, decided to vote against cloture for this reason.

“I will defend the right of my colleagues to offer amendments on this issue and other issues that are being brought up in connection with the defense authorization bill,” Collins said this morning. “They need to have a civil, fair and open debate on the Senate floor.”

To that end, Senate Minority Leader Mitch McConnell (R-Ky.) proposed a motion to move to debating the bill only if Democrats would agree that none of the first 20 amendments would relate to immigration — effectively killing off the chance that Reid could add the DREAM Act to the defense authorization bill. He also tried to get Reid to agree to allow Republicans and Democrats to offer amendments in an alternating order. “We should start work on this bill and tackle the unrelated issues later,” McConnell said. Reid objected and brought the bill to a vote.

Many Republicans’ arguments against moving the bill to the floor were rooted in their opposition to a Don’t Ask, Don’t Tell repeal or to the DREAM Act. Some Republicans also argued a repeal of Don’t Ask, Don’t Tell would be inappropriate, because the Department of Defense has not yet completed its review of how the policy would impact the military. The proposed amendment would have remained pending until review was completed and submitted to the president, secretary of defense and chairman of the Joint Chiefs of Staff.

Opponents of the DREAM Act also relied on the argument that it did not belong in the defense authorization bill to begin with. “We’ve opposed the DREAM Act on its merits and we were certainly opposed to the use of the military authorization bill as a vehicle to reward people who are in the country illegally,” Ira Mehlman, a spokesman for the pro-enforcement group FAIR, told TWI after the vote.

But the DREAM Act has supporters in the defense community. The Department of Defense’s Strategic Plan for the 2010 to 2012 fiscal years recommends passage of the DREAM Act as a way to help the military “shape and maintain a mission-ready All Volunteer Force.”

Colin Powell, former chairman of the Joint Chiefs of Staff and a retired general, encouraged Republicans to vote for the DREAM Act during an appearance on Meet the Press Sunday. “We can’t be anti-immigration,” Powell said. “Immigrants are fueling this country. Without immigrants, America would be like Europe or Japan with an aging population and no young people coming in to take care of it. We have to educate our immigrants. The DREAM Act is one way to do that.”

Moving forward, immigrant rights advocates said they will continue to pressure Senators to support the DREAM Act, whether it be as a standalone bill or an amendment to another piece of legislation.

“This isn’t lost,” Juan Escalante, a spokesperson for The DREAM is Coming, told TWI. “We’re going to push Senator Reid to make sure the DREAM Act happens in another way.”

I'm very disappointed with the Dream Act not passing. Now I have no hope for the future, this was my only chance to be able to go to school in January. I can't afford it any other way and I can't get loans and they won't give my mom any for the amount I need…. I don't want to go back home, this IS my home, USA. Hopefully something will happen soon. I'm getting older and my chances are slimming.

This fillibuster wasn't about gays in the military. It was about the Democrats and Obama supporters trying to shove legislation down the throats of anyone that diagress with them. All the Republicans are asking for is time for debate and to deparate this amendment from the Defense Act.

The Dream Act is just another form of why Illegal parents have children in the U.S. It is so that they too can become citizens by circumventing the proper process of this Great Nation. This is no fair to any other countries who have legal immigrants in the U.S. Once again all you have to do is cross the border with your illegal child.

Think about it.. How many illegals will cross with their children now so that all that needs to be done is the children attend college or 2 years of military service?

You honestly do realize that this is yet another form of an Anchor Baby right? Once the child turns 21 they can officially submit to ICE in order to petition for their Illegal parents whom more than likely are already in the U.S.

Yes!! Come to the U.S. with your children. Hide out long enough until they can attend college or two years of military service and VIOLA!! Instant U.S. citizen who can submit for their illegal parents.

No, this nation (the USA) no longer belongs to immigrants. Yes, many legal USA citizens are descendants of immigrants. Even “native American” USA citizens are descendants of immigrants (Bering Strait).

However, wars were won; laws were past. Illegal aliens are criminals (violating federal law) by their mere presence in the USA. They deserve NO government aid.

Gays in the military. Bunk them with the men, or with the women? or with other gay males? Or other gay females? Where? How? Private rooms? It's enough of a wrinkle in defense logistics and legalistics to have female barracks on bases. What does sexual harrassment look like? The possibilities are too many and too ancillary to the military mission to burden the military this way.

It's sad to see that some Americans haven't change a lot since contemporary times. I keep reading American history and I can't believe what treatment white people gave to black people. Time moves on, and now slavery is wrong. Same here, many Americans dislike illegal immigrants because they brake the law and such. How does that affect you anyway? You guys are pretty ignorant. Though the majority of the illegals may be Mexican, Guatemalan, etc. there are a group of illegals that derive from Asian, European, etc. that just got caught up in the very inefficient immigration system that is in place right now. There is no doubt that there needs to be change. Though the age requirements seemed a little lenient for my taste, I think this is a good idea. Not to mention that illegals that we're trying to target are the ones (not just attending community college) but are joining the army and going to graduate and professional school (medical school, etc.) In other words, most of these guys are smart as any other “American” you'd stack up against them. You may complain all you want about the stereotypes, but if you open your eyes, this is a freaking good idea that gives one hope to those smart students that are trying to find a life.

The failure pf the DREAM act to get cloture reflects the mood of 75% of Americans: No NEW avenues to citizenship until we have our southern border under control. That the Republicans would filibuster a defense bill over this just shows the level of frustration in the country with this administration's failure to enforce immigration law.

It takes years, approximately 5-10 to evaluate a petition even for immediate family and even then it can be denied. It is a controlled way to allow people to immigrate.

I don't agree with illegals pouring in through borders. But this dream act is about the youth who did not have a choice. This is their home legal or not. Their place of birth is foreign to them.

How about LEGAL immigrants? Are they not American either? We have US Governors who were born in a foreign country! This country was built by immigrants and immigrants will always be a part of it.

I agree that people shouldnt border hop. But this act is about the kids who were brought here unwillingly at young ages wen they have no other choice. They grew up here, many don't even speak their native language and know nothing about their place of birth.

What a shame that you are saying the United States is going to become a “a third world toilet bowl.” Just because we are immigrants does not mean we are trash my friend.

Some of us actually do well in school. Some of us actually outperform US citizens, in a very competative high school. If I took the spot of your child in class rank or in a college it is because I worked harder, volunteered more than you child, and was more pro active in our community because I actually want to contribute for the good of America.

Some of us actually understand politics. Just because this happens I am not going to degrade the Republicans. As much as I know it may seem unfair to some people, I will respect the system, but I will not just read that we will become a “toliet bowl” because you are legalizing illegal immigrants.

We do have brains and we do have potential.

Why would you go back to a country you HONESTLEY don't know since you came from a very young age (<5 y/o), but you do know the “Star Spangled Banner”, the Pledge of Allegiance and has successfully passed an AP American History course.

I don't care… make the DREAM Act as STRICT as you want. GPA requirements, criminal background even SAT scores, but I do believe America needs a way for immigrants that really are contributing to the America to become legal productive citizens.

Whats the difference from bringing a Statistician from a different country, than allowing an illegal immigrant who has been raised here all their life, knowing all the traditions, to be able to be educated and find a job as a Statistician?

During segregation most of the people wasnt in favor of avoing it and giving people their constitutional rights. Not just because the majority of the people thinks something it makes it right. One needs to think beyond. It's incredibly sad, the Dream Act is an opportunity for bright students to help benefit the United States. A pathway to citizenship for YOUNG people to be fair contributor. Receiving legal status would mean working and paying taxes, doing things the RIGHT way because they did not have a choice to come to this country. These young people are going to be educated!! We're talking possible doctor's, lawyer's, etc. I am in no way saying it's okay for people to cross illegally but has anyone stopped to think that maybe there's a REASON why they can't come here legally?? I know that doesn't make it right, but for the people who have been here for years and years, that have never known any other place and want to make things right, why wouldn't the United States want to give them a chance to be a possible good citizen? I'm all for the Dream Act having requirements of course, background checks, English MANDATORY (which majority of students know better than their own foreign language) etc. I hope people can become more open minded and maybe look up what the Dream Act really is and it's requirements, maybe read some articles of students who may benefit from it.

now i am not against immigration, however i am against illegals coming across, not paying taxes, and we the citizens living in a semi-socialist country, are paying for their healthcare their food stamps and whatever else we pay for.

Im also against giving handouts on the street to beggars. They're not reporting that as income on their 1040s.

Until this goverment stops giving handouts to every person thats in “need,” the country as a whole will never be ok with having these immigrants come over.

If there was a simplier way to allow them to come here legally, where they would pay taxes like everyone else, then there would be a greater acceptance.

Why do you think they were brought here unwillingly?
What makes you think that they don’t know anything about their home country?
No one has asked the question that if they were brought here that many years ago they probably have siblings that were born here..made legal…which is another problem.
Also, if being illegal, wouldn’t that mean that their parents are illegal also. What happens to them when their children come forward under the Dream Act? Does it mean that they will be deported? They should be..
As for legal immigrants……….they are or will be citizens…no one has a problem with that..
A great deal of immigrants came thru Ellis Island and looking at the forms these people had to have sponsors and pay a fee to enter. That is how our ancestors came here.
Also they couldn’t be a burden on this country.
When did these rules change?
Our country cannot take on the financial burden of having “open borders” and that is what this law would bring about….more to come …
Do you remember when Reagan gave amnesty back in the 80′s…I am thinking it was for 3 million…
Look how many more are here illegally some 20 odd years later…at least 13 million…
I really think if these people that want to live here BUT still love their country should find a way to make their homeland better…
It is NOT our responsibility to take everyone in..we just don’t have the resourses.

For your information we are going to be paying or our own education. The DREAM ACT is just a chance for young immigrants go to college and have a future like every other white person in the US. And some of us are actually smarter than white people some of us make more money than white people i bet you my GPA is higher than most of the white people in my school.
