Sen. Al Franken (D-Minn.), an alumnus of the NBC show “Saturday Night Live,” criticized the proposed merger of NBC Universal and Comcast during his question-and-answer session today with Supreme Court nominee Elena Kagan.
“If the same company that runs the pipes also runs the programming, we have a problem,” he said.
Franken later said that if the merger goes through, “it would have the ultimate ability to keep others from publishing.”
He used the proposed merger as a way of framing a discussion with Kagan on media law. Though Kagan declined to comment specifically on the proposed merger, citing the Justice Department’s current investigation into the merger proposal, she said the First Amendment does not provide a general defense to existing U.S. anti-trust laws.
