Orrin Hatch: Let’s Drug Test Unemployment Insurance Recipients

Via Matt Welch at Reason, Sen. Orrin Hatch (R-Utah) has proposed an amendment to the jobs bill requiring that recipients of unemployment insurance or welfare benefits get drug tested before they get their checks. From the Salt Lake Tribune:

People seeking unemployment benefits or welfare would have to first pass a drug test under a proposal Sen. Orrin Hatch will try to add to legislation extending the social safety net during this time of economic turmoil.

Hatch … said his idea would help battle drug addiction and could reduce the nation’s debt. He will try to get the Senate to include his amendment to a $140 billion bill extending tax breaks and social programs this week.

“This amendment is a way to help people get off of drugs to become productive and healthy members of society, while ensuring that valuable taxpayer dollars aren’t wasted,” he said after announcing his amendment. “Too many Americans are locked into a life of a dangerous dependency not only on drugs, but the federal assistance that serves to enable their addiction.”

Currently, about 4.4 million families receive assistance through the Temporary Assistance for Needy Families program. On top of that, 9.8 million people are receiving unemployment insurance in some form. Millions more get other kinds of aid. Granted, the federal government does plenty of drug testing already, but does it really want to process 15 million new urine samples? Plus pay for all the court cases the law would create? The Drug Policy Alliance notes that “a 2003 ruling by a federal appeals court that covers the states of Kentucky, Michigan, Ohio, and Tennessee ruled that states cannot drug test welfare recipients because it’s unconstitutional.”

Welch writes, “This is, alas, nothing new. In addition to social-welfare recipients, lawmakers have identified several other sub-classes of people ripe for being forced by the state to urinate on command, including (but not limited to) student athletes, kids who dare take part in other extra-curricular activities,” and others.

Perhaps the first step should be Drug Test for all members of Congress.

This should include alcohol and prescription drugs as well.

They also should take a 25% paycut and the wages frozen until the economy is back on it's feet and the budget is balanced.

They hand Trillions to Big Banks and Wall Street with no drug testing involved, or even any accountability involved. Since no Republican has worked (they're supposed to be working FOR their constituents) since the inauguration of President Obama, I say the penalties should be retroactive, and the money put into the pockets of the very same people Hatch seems to think are lazy. Drug tests are a joke; they can be beaten 100% of the time by a $20 bottle of Gold Seal from local smoke shop. I really don't know how anyone ever tests positive. So, basically, you'd just be forcing folks to spend part of their check on an unproductive purpose. What it really does is create another barrier to people receiving public benefits. Some people may be averse to peeing in a cup in front of a stranger. I had to do it at least 25 times as a college athlete; it's uncomfortable. It doesn't seem right to make a struggling single mom have to do that so she can receive basic support for her family. Republicans want to control spending, and that's commendable, but they are generally hostile toward the poor, who they deem as lazy, or somehow deficient. I don't dig that at all. Rather than cutting benefits to the poor, let's get rid of farm subsidies…

What is highly ironic about his suggestion regarding unemployment benefits is the recipient had to be a working taxpayer prior to losing their job and generally had to have been employed at least 18 months (have earned money in 5 quarters) or so prior to filing. Most of the time the employee must not be at fault for the job loss. Plus you have to perform a certain amount of work searches each week.

While receiving any kind of TANF or other “welfare” type help, each adult person in a household that is not disabled must find work of at least 30 hours a week or they will assign you to “make work”. The only exceptions are generally if you have a doctor saying you are unable to work. Even receiving food stamps require you to be looking for work and generally register with a state job service and perform job searches.

Senator Hatch was a part of the senate when reform was passed but he must not remember what they did to poor people. Another of life's ironies- it takes more paperwork and documentation to apply for any kind of public assistance than it does to apply for a loan or for many of the government programs for those who are not poor. Congress, especially the right, is very tough on those who are powerless all the while making easy life even easier for those who have. And yet they profess this is a “christian nation” living under the ideals of Christ. I'm not sure where that is happening. I don't see it.

Lets see we are going to drug test the unemployed because…

How about lets drug / alcohol test the people that can declare war, dilute the Constitution and refrain from extending unemployment benefits. Lets drug test the folks that have the decision power that effects the rest of us.

Then lets devise a test that shows why you make a political decision such as “they gave me a lot of money”.

Finally lets devise a test that gives an objective rating on whether you have benefitted the nation during your time in power.

look…as most americans and most people in the civilized world for that matter, we have to be tested on a regular and sometimes random basis just to keep our jobs.
we have to be tested to keep our jobs so we can pay the taxes that fund the people looking for a free ride. isn't only fair that if i have to be drug tested to give my money to support them, that they should be drug tested to recieve it?

If you use gold seal you are not going to get good results. Gold Seal has been known to be a total waste of money and will never work to beat a piss test. If they see you have been using it, the test results my be within limits but it is listed as a prohibitive substance and your test will be rejected as inconclusive or they could call it a positive by the mere fact that you have been using gold seal and gold seal is used as a masking agent for illegal drug use. The best way to beat the test is to not use drugs. However, I know I won't stop smoking pot broke or not. Don;t take any piss test where they watch you. If they don't, there are ways to beat it.

I recall reading about a bus company- I believe it was a city bus line somewhere here in the U.S., that instead of doing drug testing of the employees, instead on a daily basis each driver had to do a computer test that tested their reaction and response time. In order to get behind the wheel of the bus that day you had to perform at a certain level. If you were unable to meet the criteria, you could be assigned to another job that day where you weren't responsible for others lives. Unless you were consistently unable to pass the standard, it didn't affect your job. Sometimes you just have a bad day.

Japanese Airlines uses biorhythm charts for their pilots. When their biorhythms are low in physical and mental areas they aren't scheduled to fly. They believe the biorhythms predict a persons ability to act and therefore provides protection to the flying public as well as the airlines.

Either scenario provides a level of protection for the public when it comes to those who operate transportation systems or big rigs and would tell an employer if a person wasn't up to snuff on any given day without violating the privacy of an employee and what they do in their off hours. Employers should not be able to dictate your life off the job. If you show up to work capable of working and doing your job well, that should be all that matters. Drug testing anyone for work related reasons is just not constitutional, in my opinion.

What I think Hatch is conveying is that since “the unemployed have all that time on their hands”, and “all that free money”, they're buying drugs with it, so he has this ridiculous idea that they be drug-tested. Trouble is, it's called UI for a reason……Unemployment INSURANCE. It's NOT free. those who are suffering now paid into that fund they are drawing from. Telling them they can't be trusted is more than hypocritical, when you consider the salary HE'S drawing, for doing absolutely nothing for a year and a half.

I agree totally with your comment, and personal responsibility plays big into it. Hatch's problem is with “giving” to the disenfranchised, like those (Hello, Bebe Homme Pleurant) who went after ACORN. There are STILL some who believe ACORN was a corrupt organization that took government money, which has been proven as false, but look what it took to “prove” it. And the person who did it got busted by his own hubris, as well as the local authorities trying to do it again with Mary Landreiu.

Hatch's statement verifies his beliefs. Just another stupid, ignorant attempt to punish the very people who are going to be a part (and I can tell you, they REALLY want to be) of our recovery.

The GOBP doesn't want that. They want this country to FAIL. F**k the GOBP.

It is also true that in order to qualify to continue receiving UI, you must do a minimum number of verifiable work searches each week and be registered with job service. Most of the people who receive UI would rather be receiving a paycheck. I just want to know how these people keep getting elected by people who proclaim this is a christian nation when their behavior is anything but? All they want to do is dump even more on the people who are just trying to survive. They aren't taking vacations, owning more than one home or living large. They are just trying to eat and have a roof. When are republicans going to start behaving as if they are humans with a heart?

Again, I agree wholeheartedly with your comment, and conclusions. BTW, I apologise for the epithets, but I am beyond appeasement at this point. I've heard nothing but idiotic statement after ridiculous proclaimation for one and a half years. They were running the commentary until the baggers opened their mouths and showed just how extremist they really are.
THEN came Barton. First it was President Obama, then his policies, then the people. When one of them apoligises to a multinational for reckless behavior, destruction of natural habitat that doesn't belong to them, and feckless comments like “I just want my life back” and “the small people”, that was the nail in the coffin, for me. I am now an activist. The right just created another one. To answer your question, they are animals. No. Worse, because I can have pity and empathy for animals.

As far as Christian behavior……..It's to H**l they're headed.

Alcohol is ill eagle if you drink to much, it can be moderated or abused, drugs really cannot if they are street drugs and all ill eagle drugs are stree drugs and no one really knows the strenght of these drugs which is why there are many deaths every year from over doses.  If one chooses to abuse alcohol then there are severe consiquencies according to state court records and attorneys that defend DUI clients it is initially about $15,000 not counting fines and license suspension for abuse of alcohol if driving and about $500 without representation for being a public drunk, how does that compare with the first time drug arrest for small amounts of pot?

You need to catch up on your reading!  everyone has that same old tired arguement without realizing how the laws have changes against alcohol and by the way tobacco.   To sound smart you have to be smart! it cannot be faked.  Knowledge is power and powerful people are smart.

For the person who is writing about ill eagles, that is not an informed response, nor do you prove any kind of real knowledge by the first post- the one I questioned. It is the most convoluted, error filled and hard to follow post I have read in a long time.

You say alcohol is “ill eagle if you drink too much”. While assuming you intend it to say illegal, that is a false statement. It is illegal to drive after drinking “too much” and in some cases can be illegal to be drunk in public, however absent those factors, a person is free to sit in their chair and drink themselves to death. Many do. Haven't you heard of binge drinking? Happens in colleges all the time and they also die from it. In addition to the slow death of killing your liver, heart and other vital organs from imbibing too much alcohol.

While “street drugs” as you refer to them can vary greatly due to how they are handled, manufactured and cut prior to consumption, I fail to see how that relates to this article about Orin Hatch wanting to add expensive drug testing as a prerequisite to receiving unemployment or other assistance if you have lost your job. They would spend more money on testing than they are paying out in benefits.

As to your last two sentences ” To sound smart you have to be smart! it cannot be faked. Knowledge is power and powerful people are smart.”, I can find all kinds of fault with those. First some people are capable of sounding pretty good but when you dig a bit deeper you discover it's all for show, so that shoots down your “sound smart you have to be smart” theory. Your last statement is frequently false. Money means power- not knowledge. I know many smart people that have no power and know powerful people with lots of money and no brains. Take the last president, for example. But if you want to sound knowledgeable, you need to spell correctly and be able to form sentences in some semblance of proper structure. Your post does nothing to indicate you have any clear grasp of the English language, spelling or the subject matter. So before you post such drivel you should check yourself. You must be blissful indeed.

I had a chat with a friend about this guy, and we laughed about his reference to sick vultures (ill eagles?)! Then passes it off as hitting a “wrong key!” Then something about “transmissions”. Look to the header of this thread before you start. Then consider, and LOOK UP Hatch's voting record on this issue. Especially those concerning UI. The record speaks for itself. Might as well say “unemployment benefits AND welfare.” Can't lump those two together. Hatch certainly does.

Recovery won't take place without those who are dependent on that insurance, just to survive. I don't need to reiterate what they have said here, but anyone who thinks this issue is just about welfare is an idiot. The GOBP just doesn't want to work for the American people. THAT much is clear.

It's also patently clear that if you have never had to go through the soul-sucking experience of unemployment, never had to go to the window feeling like a dog that's just been kicked, you have NO say. Your experience and so-called knowledge is one-sided, and therefore has no veracity.

I don't think it would pass constitutional muster if it did make it into the bill, but the fact that Hatch only wants to attack the disenfranchised and poor says a lot about him. He is an ass of the highest order. But if he succeeded in getting such a thing passed, unless they were going to make rehab free or set up a program to pay for it, even those who couldn't pass a drug test would have no options for stopping. I predict we would see a rise in crime- especially burglaries, armed robberies and theft of property crimes, because people who are unable to find jobs and who can't get unemployment or other assistance would find themselves with few legal options. More families would end up homeless and in shelters and more children would probably end up as victims. And it sounds like Hatch would benefit financially too. Yeah, he's a real prince.

If they can't quit for that free money, they truly do have a problem. It'll give them incentive to work. You realize, I hope, that meth doesn't stay in the body long term and you can test clean within 2 to 4 days or less. Same with several other harder drugs. And if you know anything about receiving assistance you would know that in order to get any you have to work, be actively searching for work and/or do “make work”. You do not get to sit home all the time and you don't get enough money to afford much of any drugs.

If you are applying/receiving unemployment, it is because you were working and got laid off or otherwise lost your job through no fault of your own. Therefore you were a taxpaying, productive member of society that deserves to receive unemployment benefits until you are able to find another job. That is what unemployment is for. For Hatch to suggest such an arcane and discriminatory measure that would be aimed squarely at the least of us demonstrates his lack of humanity and compassion and shows that he would rather take food out of mouths of those who can't afford it than he would to require those who can well afford to pay- big business, corporations and his wealthy contributors to pay a larger share. He needs to go back to school in his church and be reminded about the compassion that you are supposed to show.

I don't know how Orrin Hatch even got elected. I live in Utah and was attending a Jazz game and they showed Orrin Hatch on the jumbo tron and the entire arena booed very loudly. The great part was that he was actually there to present some award I think to the mascot the Jazz bear, that is how important he is. Hatch should have a stick shouved up his ass I am 63 years old and have never one time done any kind of DRUGS or smoked pot so this man needs to be put out to pasture and the PRESIDENT should put him in his place IF HE HAS ONE and it most certainly should NOT be in the SENATE. I have worked all my life and paid TAXES so why should me and thousands of others be thru under the truck. Maybe they should drug test the whole damn SENATE for starters then we may see why some of thier statements are so damn STUPID

I completely agree. I am 62, worked 42 years. What a slap in the face. Most of the unemployed people are not on drugs (although an awful lot of employed people are — why not test the whole country? duh) The idiots on here that believe Hatch cannot be taught — don't even try. Oh, but in Hatch's twisted hatch the cost is justified if it keeps even one person from being entitled to collect UI or any other benefits funded by taxpayers. He discounts the cost of testing to save the benefits. Of course, in his twisted mind, it is probably one of those unfunded mandates they would place upon the states.

we lost our home due to our company closed i have filled out at leat 300 application over the internet , in person . I am A hard worker and even though I was in upper management for over 20 years I am not to proud to take any job. my sons birth day is comming up how do i tell him we cant get you a cake you cant have kids over for your birthday we have no funds .Can anyone tell me what we do how are we going to make it i dont even have gas money to put in my car anymore not that i will have it much longer .

If you are on welfare that is provided by taxpayers who have to take drug tests why then wouldn't welfare recipients have to take drug tests? They are illegal drugs and if you are buying illegal drugs with taxpayers money – well that is an even bigger crime. Maybe take the money away from the drug buyers and give it to the people who have lost their jobs? That's better than letting the drug users have it.

totally in favor of this and anyone who isn't must have drug issues themselves. how is it unconstitutional to drug test someone on assistance, yet it's ok when you are working and your employer drug test you? Anyone found using drugs on any type of assistance should be required to get clean, offered programs to help and if they do not do what is required then off assistance they go! I know too many drug abusing disability/unemployment/welfare people and I am tired of supporting their habits!

I think it’s reasonable to want our tax payer dollars to go people who are having a hard time finding work in this economy. It is unreasonable for our tax dollars to support some loser who is using his unemployment check to buy cocaine, which in turn gets some teenage kid in Juarez shot by a gang of narcotraficantes. Some people have been getting unemployment for 18 months, and blowing it all on booze or up their noses, that shit has got to stop.

THat’s bogus! They know, the only drug that stays in your system more than 24hrs is THC from cannabis! (upto 30 days in fact) So only a idiot, or a cannabis user would fail the test! Herion, cocaine, pcp, LSD, vicodin and methamphetimine users would still get to milk the system! Is that really what we want? Yeah, didn’t think so. You wanna filter out drugies from the system? Make sure they’re following up job applications! Heck 99% of employers perform their own pre-employment drug screens anyway. And if you fail, your off unemployment

I’m Robert, I smoke pot and have for over 20 years. I have a B.S. in construction managment, and take a yearly drug test and randoms 2 times a year so 3 tests a year or 1 about every 4 months, I draw my ui benefits between jobs just like everybody else in the construction industy. the only people this bill will efect is the pot heads, do to the amount of time it takes for the thc to be flushed from the fat cells in your bodie. So with all that said take your test and stick it up your a??. What I personally think is thay should leagellize pot and tax it just like thay do with cigs and spirits that have been proven to kill. That right I AM PRO POT!!! So I think I will roll a fatty and go deposit my ui check. Good luck to all of you in a bind hope you find a job.
