ACORN Investigator James O’Keefe Arrested

James O’Keefe, who posed as a pimp for undercover sting videos that badly damaged the credibility of ACORN, has been arrested for apparently trying to pull a sting on the office of Sen. Mary Landrieu (D-La.).

FBI Special Agent Steven Rayes alleges that O’Keefe aided and abbetted two others, Joseph Basel and Robert Flanagan, who dressed up as employees of a telephone company and attempted to interfere with the office’s telephone system.

A fourth person, Stan Dai, was accused of aiding and abetting Basel and Flanagan. All four were charged with entering federal property under false pretenses with the intent of committing a felony.

O’Keefe had become a conservative media star since the ACORN sting. I just talked to Lisa De Pasquale, director of CPAC, who said that O’Keefe, along with co-stinger Hannah Giles and Andrew Breitbart, is (or was) under consideration for the annual conservative conference’s coveted Reagan Award.

Mike Flynn, the editor of Big Government–where the ACORN videos originally appeared–told me that the conservative news site had no knowledge of what O’Keefe was up to.

“We had absolutely no clue what he was up to,” said Flynn, “and now you see why! It’s a complete surprise to us. We’ll just see what happens.”

UPDATE: The FBI’s press release on the case:

Four Men Arrested for Entering Government Property Under False Pretenses for the Purpose of Committing a Felony

NEW ORLEANS—JOSEPH BASEL, age 24; ROBERT FLANAGAN, age 24; JAMES O’KEEFE, age 25; and STAN DAI, age 24, were charged in a criminal complaint with entering federal property under false pretenses for the purpose of committing a felony, announced the United States Attorney’s Office for the Eastern District of Louisiana.

According to the complaint, which was unsealed earlier today, the arrest of FLANAGAN, BASEL, O’KEEFE, and DAI took place after BASEL and O’KEEFE attempted to gain access to the New Orleans office of United States Senator Mary Landrieu on January 25, 2010, while posing as telephone repairmen. According to the complaint, FLANAGAN and BASEL were each dressed in blue denim pants, blue work shirts, light green fluorescent vests, tool belts, and construction-style hard hats when they entered the Hale Boggs Federal Building, located at 500 Poydras Street, New Orleans, Louisiana 70130. Once in the building, FLANAGAN and BASEL sought access to the offices of Senator Landrieu. O’KEEFE was already present in the office, holding a cellular phone so as to record FLANAGAN and BASEL. Once inside Senator Landrieu’s reception area, FLANAGAN and BASEL told a member of Senator Landrieu’s staff that they were telephone repairmen, and they requested access to the main telephone at the reception desk. FLANAGAN and BASEL then manipulated the telephone system. FLANAGAN and BASEL next requested access to the telephone closet because they needed to perform work on the main telephone system. They were directed to the main office of the United States General Services Administration, also inside the Hale Boggs Federal Building, where they again represented themselves to be employees of the telephone company and stated that they needed to perform repair work in the telephone closet. Both FLANAGAN and BASEL stated that they had left their credentials in their vehicle. In addition, the complaint alleges that O’KEEFE and DAI assisted FLANAGAN and  BASEL in the planning, coordination, and preparation of the operation. The men were apprehended by the United States Marshal’s Service soon thereafter.

If convicted, FLANAGAN, BASEL, O’KEEFE, and DAI each face a maximum term of 10 years in prison, a fine of $250,000, and three (3) years of supervised release following any term of imprisonment.

The United States Attorney’s Office reiterated that the complaint is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The investigation is being conducted by Special Agents of the Federal Bureau of Investigation and Deputy Marshals with the United States Marshal’s Service. The case is being prosecuted by Assistant United States Attorney Jordan Ginsberg.

I was always under the impression that there was a security checkpoint one would have to get past before getting that kind of access. Is that accurate? If so, any idea how they managed to get past it?

I think this is a bigger story is because so many people who have a lot of enemies planted their flag with James O'Keefe.

Remember even Jon Stewart praised James O'Keefe, but FOX News went to town with him. Congress, controlled by Democrats, passed a bill specifically to defund ACORN just based on James O'Keefe's work.

So yeah, this is going to be a story with some legs and then “trivia and bigger fish” folks can sit on it.

Considering that one is the son of a US DA, you'd think that they wouldn't actually be trying to bug a phone line, right? In fact, the more likely explanation is that they weren't trying to do that but were trying to do something else. Oddly enough, Dave Weigel doesn't seem to be considering that possibility; whether it's because he's just being his normal hacky self or because he isn't bright enough to think up other possibilities isn't known, but I suspect it's a combination of the two.

In any case, if anyone wants to do things in a perfectly legitimate and highly effective way that will raise the level of debate in the U.S., help promote this plan. I've been promoting that in vain for almost three years, and if Breitbart had followed it instead of posting tea party screeds and the like he'd have had a far greater impact than he's had. Of course, that plan requires people who aren't compromised, and it's difficult to find many people like that.

That's as classy as I've come to expect from some commenters at this site, so thanks for living down to stereotypes.

Since I posted the above, I've read the affidavit. It says nothing about “wiretapping” or “bugging”; I got that from false reports on other sites. It only says they were trying to “interfere” with the phone system.

If, for instance, they had caught them with wiretapping equipment (which you need in order to do any wiretapping), no doubt that would have been included in the charges. My original hunch appears to be correct: they were probably just doing something like trying to show how easy it could be to wiretap, with no intention of doing any wiretapping.

I eagerly await a follow-up from Weigel, sometime during the next ice age.

Senator Landrieu was not the target of a local police or state police or an FBI requested court ordered “interfering with (an elected federal officer's) official phone system” or a wiretapping. The federal criminal charges today were brought against four young men, three arrested while trespassing under false pretenses. Determining exactly what they were doing in the Senator's office and why they were in a federal building with out any clear civil or legal purpose will be the prime object of the criminal trial to come. They remain innocent until proven guilty. But given the evidence made public, the case against them looks pretty strong.

Let’s face it, all charges will be dropped, because he is poor white trash. This Tuesday, James O’Keefe was arrested by the FBI, for entering a federal property under false pretenses with the intent to commit a felony and maliciously interfering with a telephone system operated and controlled by the United States of America. They were dressed up as telephone company employees with tool belts and fluorescent jackets. It appears to be a bungled attempt to wiretap the office of Democratic Senator Mary Landrieu, in Louisiana and paid by Andrew Breitbart.

If it turns out that Sen. Landrieu was doing something illegal that they were trying to catch her at, than they should be let go since all they did is EXACTLY what the police/FBI or other law enforcement agency would have done.
If it is legal for law enforcement agencies to do this to catch someone breaking the law, then it is legal for every American Citizen to do it. If it is illegal for an American Citizen to do this, then it is doubly illegal for law enforcement agencies to do it.

Those arrested were referred to as “kids” in some news agencies. They were all either 24 or 25 and grownups. They went to the trouble to meet up hundreds of miles from home for 3 of the 4. Two of them impersonated legitimate telephone industry workers complete with what they think would be work ensembles. There is a claim of “journalism” here. Where? They are strictly scamming. They are a seeming self-appointed truth squad looking to do what? Expose that a lot of people call Senator's offices. Better to spend this kind of time at V.A. hospitals. They were set up a bogus scenario to either expose or worse. Come back later and perform a terroristic act? How is one to know? Regardless, these men need to man up and prepare to the the time. I am sure they are very familiar with the phrase, “If you can't do the time, don't do the crime.”

I like how liberals caught on tape doing bad stuff and can’t deny it, they just call O’keefe a criminal because of his past arrests. What they fail to mention is that those arrests were made by trumped up charges from democrats which have yet to be proven. O’keefe has not been found guilty of anything, he has simply been indicted which means brought up on charges all of which are laughable.

O’keefe has been charged with:
Entering Government Property Under False Pretenses for the Purpose of Committing a Felony aka Entering offices of government officials like senators offices posing as a character like he did with acorn and other liberal groups posed as a pimp. Doesn’t sound very malicious with a lot of intent to do harm in retrospect does it?

Liberals can then call him a criminal because he was arrested whenever they want to dismiss his stories of their corruption or wrong doing because technically wouldn’t be lying about him being a criminal but then again they never relate that accusation and what he did to the story topic at hand for some reason… hmmm….

Anyway the one example which democrats constantly use to dismiss O’keefe’s investigative journalism integrity for his pieces which all too often uncover corrupt democrats, cover ups and collusion with supposed non-profit groups and corrupt non-profit groups, etc. they always call him a criminal referring to the time he was arrested BY charges filed by democrats for this very purpose.

O’Keefe’s crime…? Well at this point they’re just allegations yet to be proven which quite frankly have been blown way out of proportion in order to put a stop to his success in uncovering crimes and corruption of the democrats and their supporters and benefactors.

In order to get into a senators office building so O’keefe could question Senator Landrieu about selling her vote for Obama’s health care bill in exchange for a Medicaid provision estimated in value at up to $365 million for her state of Louisiana. O’keefe had to pose as a telephone repair man with his colleagues which apparently is a crime to pose as utility worker or someone your not when on government property, who knew?

He proceeded to track down the subjects of his investigation to record a reporter interview using his cell phone video camera only to be arrested before leaving the building so that story would be released immediately. O’keefe was also “accused” of tampering with the phone systems however none of that has been proven as he never touched it, that was not his intent but because of the phone repair outfit and toolbox was accused of doing so in order for democrats to pile on additional charges which would keep him silent longer as he remains in the court system trying to clear his name.

These are just cheap political stunts orchestrated by democrats to silence a very effective investigative journalist who continues to expose liberal lies, fraud, corruption and other violations of law.

This makes it so much more interesting that democrat appointed Assistant United States Attorney General is leading the charge in his prosecution after the previous Assistant Attorney General and parent of one of the investigative reporters quit and had an immediate replacement appointed by Obama to take over the prosecution.

It’s interesting how the Attorney Generals office drops charges against black panthers at polling booths who brandish weapons and are found guilty are released with all charges dismissed by the democrat appointed United States Attorney General Eric Holder out of the blue for no apparent reason or explanation.

This is the same Attorney General who refuses to investigate ACORN for numerous violations of laws stemming from election fraud and non-profit funding violations after milking tax payers for Millions of Dollars every year yet inconspicuously rally for a particular political party (A direct violation of non-profit status rules). (Note ACORN is not out of business they just had every one of their branches change their names so they are no longer so easily recognizable).

This is also the same Eric Holder who also refuses to prosecute or even investigate planned parenthood, the group that has been caught on tape over and over again offering abortion assistance to minors without the consent or notification of their parents and of under age 12-14 year old enslaved prostitutes. It sounds a lot more like Eric Holder is really more concerned about protecting his political allies over the interest of children and upholding the law except when it is convenient to his democratic political allies.

O’keefe and his crew are heros only tarnished by their much more powerful opposition (liberal media and the democratic caucus.) and a true investigative reporter by all means of the definition.

These are just a few charges blown way out of proportion by democrats to get him arrested so they can dismiss him and his stories as somehow not being credible, this is hard to swallow just looking at all the corruption he has uncovered about democrats and their supporters/benefactors which managed to dethrone CEO’s of major corporations & Non-Profit Groups and Media Outlets such as NPR, etc.

You can see all his opposition doing it already without any additional explanation of charges against them, the liberal media outlets and politicians simply blow off comments about new stories he releases such as the one about the NJEA (New Jersey Teachers Union) citing him as “having a criminal history” and not a credible source!

It’s amazing the attorney generals office is pursuing this so vehemently, AMAZING~!

Democrats continue to receive hundreds of millions of tax payer dollars through supposed non-profits and other back door channels like this via deceptive practices in return for some political favors come election time. I really find it all sickening, any tax payer should, not just democrat, republican or otherwise. If you can honestly tell yourself this isn’t corruption you’re only fooling yourself.
