To hear the Democrats tell the tale, the extension of jobless benefits enacted over the weekend will provide those living in high-unemployment states with an additional 20 weeks of insurance.

Well, not quite.

Because the bill was held up for so long in the Senate, an end-of-the-year filing deadline will prevent anyone from accessing the final six weeks of benefits, according to state officials and sources on Capitol Hill.

On Friday, President Obama signed into law legislation extending jobless benefits by 14 weeks nationwide, with an additional six weeks for those states where unemployment rates top 8.5 percent. Those benefits kicked in on Sunday. But there’s a glitch. The new law treats the 20-week extension as two separate extensions of 14 weeks and six weeks, with participants required to exhaust the first 14 weeks before applying for the next six. However, the current law keeps a Dec. 31 application deadline, roughly seven weeks from now, making collecting the full 20 weeks impossible.

[Congress1]That’s not all. The emergency unemployment benefits provided beginning in 2008 are also tiered. The filing deadline applies to all tiers. That is, the new extension would effectively grandfather the unemployed into the tier where they sit at the end of December, preventing them from jumping into the next, even if they were eligible.

As a result, some members of Congress are already eying another sweeping unemployment extension, which would both address the deadline glitch and provide additional help — well beyond the six weeks in question — to those unable to find work next year, when jobless rates are expected to hover near double digits.

The Orange County Register first reported on the deadline glitch last week.

In a state like California, where unemployment currently stands above 12 percent, that technicality would prove significant. Loree Levy, spokesperson for California’s Employment Development Department, said Monday that an estimated 92,000 residents had exhausted all of their available unemployment by the end of October, and roughly 285,000 will be eligible for the newly enacted benefits by the end of the year. Whether they can get 20 weeks or only 14, though, depends on whether Congress extends the filing deadline.

Some in Congress are well aware of the problem. The office of Rep. Jim McDermott (D-Wash.) said Monday that he’ll be pushing a proposal to provide as much as an additional year’s worth of jobless benefits. The proposal will be wrapped into a package to include other provisions designed to ease Main Street’s pain amid the downturn, including money to subsidize COBRA health benefits, as well as a provision to extend the full federal funding of a traditionally state-federal unemployment insurance program called FedEd, which got full federal funding under the stimulus bill. Without congressional action, states would again have to pick up part of the FedEd tab at the end of 2009.

McDermott doesn’t have an easy task. The pricetag for extending just the unemployment benefits for one year is roughly $80 billion, the McDermott aide said. With deficit spending having topped $1 trillion in the last fiscal year — and with an enormous health reform proposal in the works — the congressional appetite for expensive new proposals is hardly ravenous. Still, with national unemployment at 10.2 percent — and no wave of new jobs on the horizon — even the most ardent small-government conservatives would have a tough time voting against additional relief.

Update: The office of Senate Majority Leader Harry Reid (D-Nev.) confirms that Congress must pass another bill to guarantee the full 20-week extension.

I don't understand this, after all the Senate did to delay the passage of this bill.

I live in NYC- NYS is one of the high Unemployment States.

My last extension benefits ran out on 10/4/09, Those were from our Gov., Gov. David Paterson from May-Oct.

People in NYC and all over the State are freaking out and trying to understand how this Bill will personally apply to them and their individual claims, etc.

It's a glitch….you will and receive up to 14 weeks of additional unemployment…but the additional “high unemployment” six weeks CAN'T be received…by anybody….because they would have to start by 12/31/09
since there are only 8 weeks left this year….that's not possible….

so pretty much every state will receive 14 weeks….because no jobs are coming….

but since unemployment is going to be a huge problem for a while…possibly several years….it is unlikely that democratic controlled washington will not keep adding more extensions….

unless the repulicans take congress in november of '10…and let the public rot while giving tax loopholes to those making 5 million or more a year (like they did from 2001-2007….and pretty much every year since jimmy carter)

I would hope so, Matt. But if you'll notice, ALL Tiers expire on 12/31. Those who exhaust the very first federal extension the first week of January will be getting NOTHING!

Holy CRAP! Why wasn't this extension done with a DATE!?! They could have at least put this one in to be valid through June of 2010. But NO…they decided to leave out that little problem.

Now they are so focused on a STUPID health care reform bill, that they will let people STARVE to death, who can't get a job. I am sorry, but I can always get Medicaid if I need to…I CAN'T get a job, so I need help to PAY THE BILLS!

Come on Congress…get your stinking act together, and pass this bill IMMEDIATELY!!!!

Umm Ryan question for you. Between 2001 and 2007 was the unemployment ever this high? No it wasnt. That is because by having tax cuts for the rich actually helps the middle class and lower class. They will hire people for work. With the Democrats crazy idea of raising taxes on the rich what do think they will do? They didnt get rich because there stupid. If the govt. is going to take more of there money they just downsize by getting rid of workers to make up for the money there losing in higher taxes

I read about this glitch before they passed the extension of jobless benefits. This was a well known fact. So why did they pass it without the date qualification information is beyond me. Maybe the republicans were so worried about getting the Acorn ammendments in the bill and Jon Kyl stated no one was running out of benefits. The Democrats knew this was a issue also – maybe they just wanted to pass it because the Republicans were giving they so much grief – and I heard they would pass the date qualification at a later date. I never in my life have seen a party as anti-middle-class as the current Republican party in my 60 plus years of life.I still remember my Grandfather telling me the Republicans were a party for the rich and the Democrats were a party that supported the middle class. That has not changed.

Isn't this incredible? It's no wonder people become cynical about their government. First the unemployment extension bill gets passed in a form that cannot be implemented,and then a health care bill gets passed with an impotent public option,and an amendment eliminating women from being able to receive proper care. Hopefully folks will find work somehow and this 'glitch', whether planned or unplanned,will be mute. Otherwise we may be in for another feet dragging display by the republicans in Congress to change that Jan.1st cutoff for filing. Should add just the level of stress and depression we all need in order to really enjoy the upcoming holidays with our loved ones. And as far as shopping for gifts,etc. this year? Well with Jan.1st hanging over our heads,forget it. That should go far to stimulate the economy in the most critical time of the year.

well i live in oklahoma and they wont even let us file for our extention they keep giving us the run around saying it doesnt apply for oklahoma i called the senates office they said it applies to all 50 states at least the 14 weeks an 27 states get 20 weeks which is understandable but why are they telling us at the unemployment office we can not file someone needs to be making calls to every state so they will understand we do get the 14 weeks i can not convince them so i am back to square one poor again

what state do you live in? Have they let you file for your extension yet ? I live in okla and they wont even let us file for ours yet their saying we dont qualify in okla i called the senate an they say every state gets at least the 14 weeks so what do we do we are back to square 1 poor

I just learned something disturbing…

The way HR3548 was worded, the new Tier 3 (the one all states get) is only THIRTEEN weeks long!

What it did was extend the previous Tier 2 from 13 weeks to 14 weeks.

No one seems to be able to answer the question “Will I get that extra week of Tier 2 if I've previously exhausted it?”

whats crazy and sad is that you say all of that like its right! How is it ok for the rich to cut people off from working and feeding their families because they are being taxed no where near enough to make a real dent in their wallets? the economy now is a direct result of the rich getting richer while the poor break their backs daily for pennies. When they realize that we have no money to be the consumers they need to keep their bank accounts fat then maybe you and the rest will get it.

This should be a seperate extension. Once you have exhausted tier 2, you shoulf be eligible for tier 3. California had a 20 week tier 3, now there is a tier 4, this recent legislation allowing 20 more weeks. Check with nelp.org to make sure on your state. Good luck

They have 14 to 20 weeks to look for employment. Plenty of time to pound the pavement and update resumes. Your right, the rich are usually the ones that are the employers providing the jobs. The way the dems are doing it, tax and spend libs. I think 2010 and 2012 will likely be a more conservative election.

Seriously? You guys are going to debate this point as if it really is this “black and white” (not a race related phrase, so don't even think about bringing that into it). If it were so easy to fix our nation's problems according to the beliefs of “larrybmclemore” and “conservative895″ don't you think it would have already been done? Obviously, our current state of affairs doesn't bode well for anyone really. Don't believe me? Pick an angle and analyze it… go ahead and really ponder it (for a moment put aside your beloved political party's views and pretend to be wholly human) from the poorest of the poor (the state this conservative voter is currently in regardless of pavement pounding and the worn out shoes it's produced) to the richest of the rich (who are obviously going to feel the impact of less spending by us apparant peons, newly made or chronic cases.) If, after you've taken the time to really examine and, hopefully, even visualize yourself in every tax bracket (for extra credit: do both the high and the low ends of each)… if, after that, you still believe you have ALL the answers then let this floundering nation know. Run for office – governor, senate, president – if there's an opening by all means run. Please, do it now! You've got my vote. For what it's worth, just know that I'm not holding my breath.

I suspect that you're confusing the recently passed Tier 3 with the Emergency Benefits bill that was passed earlier this year.

Here are the extensions as they exist so far:

1) Federal Tier 1 – 13 weeks all states
2) Federal Tier 2 – 14 weeks all states
3) “State” Emergency Benefit – length determined by unemployment rate
4) Federal Tier 3 – 13 weeks – all states
5) Federal Tier 4 – 6 weeks – states with 8.5% unemployment only

Here's how you can tell whether you're on the Federal Tiers or the extension given to the individual states: Tiers 1 & 2 do not require that you specify where you applied during the benefit weeks. State managed Emergency Benefits do require that you report this.

I believe they purposely left the date out so that way it would be easier for them to argue that they absolutely need the dec. 31 deadline to be extended all the way through 2010, gives them a reason to bring it up. Hmmm…. you think their that smart I would have done that. This would give everyone the benefit of the doubt to be able to claim all of the benefits that we all deserve, not just the select few it just would'nt be fair.

I did my filing online. When done this way, the form has lines dedicated to entering this information. When the filing is done over the phone, the person taking your claim will ask where you've applied.

This stage applies only during the state Emergency Benefits period. It does not apply during the initial federal extensions period, and it may not apply during the first 26 weeks of your state's unemployment period (this would depend upon the state's requirements)

Hi all, I see we are all here again. This is crazy. I just spoke with two different UC service representatives here in PA and was told the following. Because of the date the bill was finally passed and the deadline of December 2009. PA residents will be eligible for either 8 or 13 weeks no more. The next representative said no 14 or 20 weeks is what you will receive because they are working to fix the “language”. In addition the first filing weeks for the extension are the 14th if you HAVE NOT exhausted your benefits and the 21st if you HAVE exhausted your benefits.

So long story short, the hold up in the Senate was crazy because the original bill is what we got. They screwed us over and they don't give a damn.

Lets put pressure on our congress to work on this situation before another life changing delay happens again. Hopefully most of us wil be able to find employment before then but we still need to help those who will not be employed.

My best wishes for all of us, I think I am going to take the first couple of checks and buy a product that seems to be doing really well in this stressed out economy. LOL just kidding but if I were not afraid to go to jail and ruin what this economy has left of my life i would buy marijuana and sell, sell, sell.

Just found out that since I exhausted my benefits on Sept 19, I will not be paid for those weeks from then to November 6th. That means my landlord will now start the eviction process.

Thanks for considering my situation when you drafted this bill. How many others are in the same boat and were waiting for the back payments?

Cant our government get anything right. First we had to wait, worry, and lose everything we have ever worked for and now we have to keep worrying. I wont be able to get a check in my hand to catch up on my bill until mid-December and that going to come too late for most of my bills. Kentucky unemployment offices still haven't heard anything and don't know anything about the new extension so I dont even know when I will be able to start claiming weeks. I'm so tired of this strugle.

Sorry, I guess it did sound like I would compete for your job. There really is no competition. With my MBA and knowledge of most industries, through market structure, and the fact that I personaly am acquainted with many CEO's and CIO's across the country, I can out postion and out sell any product to any company. That puts me well over any employee currently holding your position.

So, just mention the name; give me a hint as to who your employer is and I will proceed. Heck, I will even do the job for half of what they pay you. Think they'll bite?

I became unemployed in Jan '08. I received unemployment benefits every week, but it wasn't until April of this year that I had to include this extra information on the claim form.

but most of us do need the ext. but to put people down is not right. We are all trying because the one's that are not trying would not be here. They would just be waiting for the mailman. Just watch your comments and dont be a hater no one needs the last word….just learn to get along. It will all get better.

and BTW it is not a welfare system, we are the people that put most of our lives into our careers and were left out in the cold. and not to try to push your button but if they didnt give all those loopholes to the big CEO's in the past we would have good jobs. If you are a police officer, as many of my family are, be careful out there times are desperate and people do not respect authority like they used to. If you are a person who just wants to scare me, I live in a time where the only thing that truly scares me is the economic recovery before me. About 7,000 Oklahomans whose jobless benefits have ended are expected to be eligible for extended unemployment compensation under federal legislation that went into effect Sunday.

People filing for unemployment are first eligible for up to 26 weeks of regular state benefits from the OESC, and once these regular benefits are finished, they can receive federal extended unemployment benefits, known as EUC Tier 1, for up to 20 additional weeks. When all eligible Tier 1 payments are collected, an application can be submitted for Tier 2 benefits for a maximum of 14 weeks. After that time, Tier 3 is available for expanded unemployment benefits up to 13 weeks.

The Worker, Homeownership and Business Assistance Act of 2009 changes the maximum number of weeks that a person can collect Emergency Unemployment Compensation Tier 2 benefits from 13 weeks to 14 weeks, and creates Tier 3 benefits for those who use up Tier 2 claims.

“This is really good news for a lot of people,” said Oklahoma Employment Security Commission spokesman John Carpenter.

The commission will mail all current and former Tier 2 claimants a determination informing them of eligibility and instructions for filing. Someone who has been paid the final week of Tier 2 benefits will then be able to apply for Tier 3, Carpenter said.

All Tier 3 claims will be backdated so that those eligible will receive benefits for all weeks in which they were entitled, said Jerry Pectol, the commission’s director of unemployment insurance. Filing instructions will be mailed to addresses on record, so it’s critical for those filing to make sure the agency has a current address, he said.

“This extension will help quite a few Oklahomans,” Pectol said.

“We ask that our claimants be patient as we implement these changes. We want to assure them that everyone will receive all of the benefits for which they are eligible.”

The state has been paying out record amounts of benefits this year, Carpenter said, and while the number of new applicants has dropped a bit in the past couple of months, there has been a rise in those receiving extended benefits.

“That number just keeps going up and up,” indicating that more and more people are going through the system “and are not able to find a job,” he said. “It’s brutal out there

Maybe the first thing you have written I agree with. I have been actively seeking employment for a long time now and I blame myself aloy for my current situation. When my company first closed I admit I did not worry, i had always worked had been with my previous employer for 10+ years, had savings a 401K, managed my finances quite well and thought, I will get another job.

Flash forward I am in a panic and think to myself what could I have done differently. I do not agree with UC being compared to welfare but the way they are handling it makes me feel like I am on welfare. Sure there may be people who are taking advantage of the current situation but there are people who would rather be employed and active and secure in contributing to their survival.

For anyone taking advantage of any situation whether welfare or UC remember karma is a B*&^$. For those of us who really need help just keep searching. I know it is depressing and frustrating but those before us have gone through it and survived and we will to. We will carry the scars but we will be survive.

By the way for all the negative and disrespectful entries this person makes towards me and all of you karma will meet him also. He is a case study on racist behavior, to take the actions of a few and then formulate a perspective that applies to all.

Yet another example of how our so-called elected representatives are NOT the voice of the taxpayer. This Bill should have been passed immediately after passage in the House in the middle of September. After weeks of stall tactics by the GOP, the Senate Republicans used this Bill as a vehicle to get the first time home buyer extension bill extended and a varry back tax credit for business. Guess who gets the short end of the deal-the unemployed! It will be a major feat for many States to get this money out to the unemployed by December. This Thanksgiving, the unemployed in America don't have much to be thankful for, as many will not have the jobless extension benefits money in hand and therefore not be able to provide food and major necessities for their families. A very sad commentary on our politicians and the political system as a whole.

I was thinking. Since the Republicans are always shouting to lower taxes,how about starting with the unemployed. President Obama sighted extending unemployment benefits AND suspending the income tax on those benefits as a part of his platform during his run to the white house. Of course this got watered down to a $2500.00 tax deduction once it hit the senate floor. Since a bill was passed to extend benefits that could not be fully implemented,and another bill is eminent, wouldn't this be an appropriate time to reintroduce that idea,and eliminate what is essentially a double tax, for the 2009 income tax season that will be burdening the hardest hit victims of this economic disaster come April 15th?

Unbelievable. First they held up the Bill for almost 2 months and then pass a bill that in effect does nothing to assist the unemployed. It is becoming increasingly clear that our so-called elected representatives and voice do not care about the American citizen. Nor do they really even have a clue as to what they are doing. I don't know if this will help, or if you've already done it, but I'd advise you to call your U.S. Senators and Congresspeople. Let them know about this problem and ask them how you can receive the benefits. These folks work for you. It's their job to solve these kind of problems.

DONT LISTEN TO THE GUY WHO WROTE THIS ARTICLE. for whatever reason, there are people out there who crave attention, and have stupid desires to cause panic…perhaps this is his way of getting it. nothing is going to prevent the 14 weeks, and 20 week extension from being available to all states. there are hundreds of members of congress…they've argued this out & thought about it from a sufficient number of angles. so, keep on pluggin away, looking for those jobs-yet rest assured u have at least a 14-20 week safety net. and, i am sure if the job market doesnt improve…before this extension is over, or soon after-there will be another extension bill on the presidents desk. i would urge people to cut back everywhere they can…instead of that cheap spaghetti, go with ramen noodles…things like that, this is the time to eliminate snacks & seriously cut back on the amounts of meats you eat…etc, etc, etc, etc…AND WHEN YOU DO GO BACK TO WORK, STOP SHOPPING AT WAL-MART!!!! LOOK FOR MADE IN AMERICA…COSTS MORE, BUT IT HELPS TO KEEP OUR COUNTRY STRONG, OR FROM GETTING WEAKER RATHER.

Hey Angie, you really need to quit buying into this 895's bullshit, I think thats what fuels him. Do you really think that him of all people, recieved a check. He dose not even qualify for benefits. You have to work to get that. If he did get any money its that welfare check he was talking about . Welfare is “FREE” money from us too, but he dose'nt know that . Unemployment checks, are checks that you earned. This tells all about his confusion, and lack of knowledge about these things, “Like thinking he's a conservative ” thats how far from reality he is. To sum up the problem. This is what economist call a structural unemployment problem with jobs that are not coming back.

Solution.

1.)Not be 30th in the World in Education, government should subsidize education at all levels even for the unemployed.

2.) Encourage exports and FREE Trade with partners that pay workers a living wage- not a communist 55 cents and hour.

3.) Government to support venture capital and Moon shot Science projects. Support small business lending.

4.) Universities to stop acting like the Communist themselves offering fellowships or humanities/under water backet weaving and encouraging math and science over propaganda.

I have analyzed our government panel and let me tell you,,I am embarrassed of this panel we have as our government, what are they really doing when sitting around that big conference table deciding what they are going to spend their next big pay check on and deciding which of us peons out here that they are looking to screw with, I am appalled,sickened but mostly saddened of this, who can be proud of something we have no control over and have to sit back and watch them endlessly screw up, this country. All we need to do is rid of those who dont give a hoot about anyone or anything except themselves. We, who actually make this country need to stick together and ” MAKE A DIFFERENCE ” I am ready are y'all

There is so much that can be done successfully, that could and would turn this mess all around, stop supporting other countries and their people,who in their right mind would support other countries and not your own, that makes no sense at all. The judicial system needs alot of work I mean alot, prisons, dont get me started on that, when you are arrested and thrown in the city jail,,why are you treated so badly,,'INNOCENT UNTIL PROVEN GUILTY” getting thrown in jail starts a whole list of things that is going to affect that individual, to much to go into but I have been doing research and there could stand a CHANGE. I am reaady to “MAKE A DIFFERENCE” are you? It will take alot of work but it can be done. We as the people need to be the ones to take the stand, fight for our rights,our country,our freedon and fight for CHANGE.

The problem with extending unemployment benefits is there is now little incentive for the unemployed to seek work. I have a friend who gets the same amount weekly from unemployment that he got working as an electrician. You think he has any incentive to find work? No, none at all.

Your friend must have had a low paying Electrician's job. The max for benefits in Cali is $475.00 a week. I made way more than that when I was employed, plus I had benefits. What people do not realize is that if the benefits are not extended..there will be more lay offs. I have had to postpone payments on my cell phone ( need it to find work, do not have a land line), my utility bills, groceries, computer ISP..need that to find work also, need gas to find work, rent is late, etc. So it will be another trickle down effect. So unless they are really trying to bankrupt America…they have no choice but to pass the bill!
