House Passes Extended Unemployment Benefits

Yesterday it was the Senate; today the House passed legislation to extend jobless benefits at least 14 weeks nationwide.
The count was 403-12. The “nays” comprised mostly conservative Republicans who oppose the tiny employer surtax that will fund the benefit extension.
The bill will provide an additional 14 weeks of unemployment insurance in every state, with an extra six weeks going to folks in the 27 states where jobless rates have topped 8.5 percent.
“This means that they will be able to survive,” House Majority Leader Steny Hoyer (D-Md.) said before the vote. “Not thrive, but survive.”
The proposal also extends a popular $8,000 tax credit for new-home buyers, while allowing businesses to recover taxes they’ve paid in the last five years to compensate for more recent losses.
The bill now moves to the White House, where President Obama has vowed to sign it into law quickly, likely tomorrow.

their is talk now of another extension on top of this one that helps good but please give money to employers to hire people thats needed also thank god this is almost done mannn its been to over due I havent seen anything since Aug but I expect to see something in the next few weeeks depending on my state …

Right now I don't care. We have exhausted all money we had. We are completely broke, raising 3 kids and no way to pay any of our bills this month. So now I hope it gets released rather quick or else we will be without heat/electric by the middle of this month.

What a struggle over nothing considering the bill passed unanimously in the Senate. Look out though, the Repubs are now ignoring what they did and TRYING TO TAKE CREDIT for the extension, believe it or not. Cochran, R-Miss., just got quoted saying how he voted for the extension and how great it is. There seems to be no limit to their hypocrisy and BS. Please remember to call the Repubs out when they try to take credit for this extension they blocked for 40 days causing untold grief for 600,000 American families.

MN UI customer service rep just said that if you have exhausted your Account already you wont qualify,,this bill is only for people that are running out currently

she told me that if i had exhausted my tier 3 extension of 79 weeks,,that this extension was for MN unemployed who have a current acct open,and are exhausting by the end of year,which will extend 14 weeks because MN is supposedly 7.3%
If MN is wrong then I apologize,but why would someone representing the UI dept not know the extent of this bill

I doubt that very much. If there is a need for EUI, it will be there. The job market will not improve for another year or so.

I want to thank everyone for being here in support of H.R. 1348. If it wasnt for you all I would have lost it like many of us here might have. Thankfully we have the internet as my folks did not in the 30's during the GREAT DEPRESSION!! You were all great.. I know it was tense, but it passed. The bill states anyone that anyone that is exhausted or will be exhausted by DEC 31 2009 which is TIER 3 is eligible. benefits will not be available after April 2009. And as of now there is no more extension in the works. hope this helps reading the H.R. Jargon is tough but I read about 20 times.

my benefits ran out sept 2,,which were the tier 3 for 79 weeks,so if i ran out sept 2,2009,,i would still be eligible for an extra 14 weeks,,above the 79 weeks that minnesotans have already recieved,,the customer service person said that minnesota is not giving 93 weeks total
this is why im so confused
thanks for trying to clarify,,i also read the bill at congress website,,but quite frankly,,dont understand alot of the wording.I wouldnt even be writing here,except for the fact that an actual MN rep said there is no 93 weeks under this bill

I as a registered Independent voter, am ashamed of how the Republicans stalled on this bill in the Senate for 3 weeks and I will NOT forget it at the voting poll in Nov 2010. We need JOBS JOBS JOBS! Healthcare reform that wouldn't be implemented until 2014 shouldn't never have taken presentent over the 600.000 unemployed who exhausted our benefits in August & September and had to wait 3 more weeks while the Republican Senates played their DELAY THE BILL games!.

HR 1548 is TIER 3 EUC and is 14 weeks in states under 8.5% and an extra 6 weeks in states over the 8.5% we already had tier 1 and tier 2 and in Georgia we had an SEB also (state extended benefit signed by the governor) the original 26 weeks UI does not count only tier 1 and 2 which is EUC as far as my DOL rep told me. If I am wrong and anyone can add please do But I was told I would recieve 20 more weeks which I would actually rather be employed than take a hand out. did you call the local dol office or the state dol office because the local offices dont have a clue. hope this helps….all the best. I will look for the actual HR 1548 bill and post it.

AN ACT
To amend the Supplemental Appropriations Act, 2008 to provide for the temporary availability of certain additional emergency unemployment compensation, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Unemployment Compensation Extension Act of 2009'.
SEC. 2. ADDITIONAL EMERGENCY UNEMPLOYMENT COMPENSATION.
(a) In General- Section 4002 of the Supplemental Appropriations Act, 2008 (Public Law 110-252; 26 U.S.C. 3304 note) is amended by adding at the end the following:
`(d) Further Additional Emergency Unemployment Compensation-
`(1) IN GENERAL- If, at the time that the amount added to an individual's account under subsection (c)(1) (hereinafter `additional emergency unemployment compensation') is exhausted or at any time thereafter, such individual's State is in an extended benefit period (as determined under paragraph (2)), such account shall be further augmented by an amount (hereinafter `further additional emergency unemployment compensation') equal to the lesser of–
`(A) 50 percent of the total amount of regular compensation (including dependents' allowances) payable to the individual during the individual's benefit year under the State law; or
`(B) 13 times the individual's average weekly benefit amount (as determined under subsection (b)(2)) for the benefit year.
`(2) EXTENDED BENEFIT PERIOD- For purposes of paragraph (1), a State shall be considered to be in an extended benefit period, as of any given time, if such a period would then be in effect for such State under the Federal-State Extended Unemployment Compensation Act of 1970 if–
`(A) section 203(d) of such Act–
`(i) were applied by substituting `6' for `5' each place it appears; and
`(ii) did not include the requirement under paragraph (1)(A) thereof; or
`(B) section 203(f) of such Act were applied to such State–
`(i) regardless of whether or not the State had by law provided for its application;
`(ii) by substituting `8.5' for `6.5' in paragraph (1)(A)(i) thereof; and
`(iii) as if it did not include the requirement under paragraph (1)(A)(ii) thereof.
`(3) COORDINATION RULE- Notwithstanding an election under section 4001(e) by a State to provide for the payment of emergency unemployment compensation prior to extended compensation, such State may pay extended compensation to an otherwise eligible individual prior to any further additional emergency unemployment compensation, if such individual claimed extended compensation for at least 1 week of unemployment after the exhaustion of additional emergency unemployment compensation.
`(4) LIMITATION- The account of an individual may be augmented not more than once under this subsection.'.
(b) Conforming Amendment to Non-augmentation Rule- Section 4007(b)(2) of the Supplemental Appropriations Act, 2008 (Public Law 110-252; 26 U.S.C. 3304 note) is amended–
(1) by striking `then section 4002(c)' and inserting `then subsections (c) and (d) of section 4002'; and
(2) by striking `paragraph (2) of such section)' and inserting `paragraph (2) of such subsection (c) or (d) (as the case may be))'.
(c) Transfer of Funds- Section 4004(e)(1) of the Supplemental Appropriations Act, 2008 (Public Law 110-252; 26 U.S.C. 3304 note) is amended by striking `Act;' and inserting `Act and the Unemployment Compensation Extension Act of 2009;'.
(d) Effective Date- The amendments made by this section shall apply as if included in the enactment of the Supplemental Appropriations Act, 2008, except that no amount shall be payable by virtue of such amendments with respect to any week of unemployment commencing before the date of the enactment of this Act.
SEC. 3. 0.2 PERCENT FUTA SURTAX.
(a) In General- Section 3301 of the Internal Revenue Code of 1986 (relating to rate of tax) is amended–
(1) by striking `through 2009' in paragraph (1) and inserting `through 2010', and
(2) by striking `calendar year 2010' in paragraph (2) and inserting `calendar year 2011'.
(b) Effective Date- The amendments made by this section shall apply to wages paid after December 31, 2009.
SEC. 4. REPORTING OF FIRST DAY OF EARNINGS TO DIRECTORY OF NEW HIRES.
(a) In General- Section 453A(b)(1)(A) of the Social Security Act (42 U.S.C. 653a(b)(1)(A)) is amended by inserting `the date services for remuneration were first performed by the employee,' after `of the employee,'.
(b) Reporting Format and Method- Section 453A(c) of the Social Security Act (42 U.S.C. 653a(c)) is amended by inserting `, to the extent practicable,' after `Each report required by subsection (b) shall'.
(c) Effective Date-
(1) IN GENERAL- Subject to paragraph (2), the amendments made by this section shall take effect 6 months after the date of enactment of this Act.
(2) COMPLIANCE TRANSITION PERIOD- If the Secretary of Health and Human Services determines that State legislation (other than legislation appropriating funds) is required in order for a State plan under part D of title IV of the Social Security Act to meet the additional requirements imposed by the amendment made by subsection (a), the plan shall not be regarded as failing to meet such requirements before the first day of the second calendar quarter beginning after the close of the first regular session of the State legislature that begins after the effective date of such amendment. If the State has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.
SEC. 5. COLLECTION IN ALL STATES OF UNEMPLOYMENT COMPENSATION DUE TO FRAUD.
(a) In General- Subsection (f) of section 6402 of the Internal Revenue Code of 1986 is amended by striking paragraph (3) and redesignating paragraphs (4) through (8) as paragraphs (3) through (7), respectively.
(b) Effective Date- The amendment made by this section shall apply to refunds payable on or after the date of the enactment of this Act.

I am wondering, because I am in the middle of my 2nd EUI benefits and it ends soon after the New Year, will this extension cover those of us not running out of benefits until Janruary or February with more EUI benefits? The way it is written it states for those whom will be running out of EUI benefits before the years end. It would seem to me that those of us running out in the next 2 months wont be eligible for this recent extension, (the way it is written) but to me that makes no common sense. Anyone know for sure?

this was on a news channel it will be because employers do not plan on hiring june or july plus unemplyment is expected to hit 15% according to Obama amidistration wait and see it will happen sooner then later I would wait till about Jan Feb to see but u will here something by then also the one that they r talking about after this should be 13 -15 weeks

if your heat or gas gets turned off call your kids doctor asap they will put in for medical and that will by u time a doctor will do it even if the kids not sick trust me i have fam thats a doctor

Call your state dol office once it is signed and made law..they will be able to help you….I do know that no benefits will be awarded after April 2010 which to me is a bunch of horsecrap as it will take more than 5 months to get out of this mess.

It is important to understand that this bill ony applies to poeple who have CURRENTLY run out of benefits OR will run out of benefits BEFORE Jan 1 2010.
Anyone who runs out of benefits agter Jan 1 2010 is out of luck. This bill does not cover them.
So ALL thus fuss and bother will cover Americans – only for another 7 weeks. After that it all has to start again – with all the Republican obstructionism all over again. The Democrats didn;t feel the need to extend the dates past Dec 29,2009 so we have to do this all over again in 7 weeks.

I spoke with my State representatives office in PA and what I was told is the following
For people who have exhausted their EUC benefits thi bill will provide you with 14 or 20 weeks of help depending on your state unemployment rate, but 14 at the minimum.
For people who will soon exhaust their benefits she was vague and said she did not want to give me bad info but she believed if you exhausted your benefits before January 2010 you will recive the same amount of weeks.
She also told me the best thing to do would be to wait until monday and call the Unemployment office, by then they should be able to tell me all the details, in PA the number is 888-313-7284

Here is the timeline and tiers as listed in massachusetts, which would basically cover all that have or are entitled to the full 79 weeks covered. The application deadline is Dec 26, 2009 for EUC08, which will probably be amended before then. You will all recieve at least the 14 weeks if you have already exhausted benefits, its the 6 additional weeks that the payment deadline of June 5 2010 that will be the problem for most. The legistature will amend this bill accordingly, they just needed to get this done so that folks can get some kind of cash flowing to pay bills and put food on the table. Good luck all !!

Hell, I almost wish I didnt get the 13 extra weeks, which started last week. That basically costs me 7 weeks of EUI benefits when the 13 weeks I just recieved are done. Hopefully I'll be back to work before than, but the way things are going, and I'm not getting any younger, lol, that may not happen. Is it just me or does this seem screwy to anyone else, that this only helps those that have allready recieved the weeks im recieving now, and not those of us that may need them in the future months?

Just a reminder to everyone, each states DOL will notify all eligible claimants by mail on how to claim to new benefits once they are handed down to each state from the Feds. Some will be lucky enough not to have to call any phone numbers because they will kick in as soon as their current befefits run out. For those that have already exhausted benefits, will probably get specific instructions by mail on how and when to claim these new benefits. Good Luck!

Below is what CA UI has posted on it's website. I am very concerned, because in the last part of the first paragraph, it states “If the legislation approved by Congress is signed by the President and enacted this week, then Sunday, November 8, 2009, becomes the first eligible week for the new benefits. Any time spent unemployed and without benefits before then is not covered by the new federal legislation.” This makes no sense. If Congress and the Senate approved additional UI benefits, extending it to those that used all of their previous FED ED extensions, how would this be correct?? I'M CONFUSED.

It provides the potential for up to 20 additional weeks of benefits for higher unemployment states, including California. Any time spent unemployed and without benefits before then is not covered by the new federal legislation.
The new extensions will require complex programming to implement once authorized. EDD is working around the clock to ensure payments can be made as quickly as possible.
In the meantime, there is no need to contact EDD. We will be contacting potentially eligible claimants and notifying them of developments. Once programming is in place we will follow up with further instructions and automatically file the extensions for as many of our clients as possible. We may also need to contact some clients at that time and request further information. Please watch this Web site for further updates.

Thats because of the editors of the website are one-sided
I just saw on CNN that the actual unemployed figures are approaching 20% and those that have a job will be negative until they are in the same position of being unemployed then they will start to think. CNN also said that alot of people are getting frustrated and giving up, he also mentioned ” I dont want to use the D-word (depression) but that may be where we are heading. The best way to I can see to make it better is bring the out-of country jobs back and eliminate any imports from those jobs. It all boils down to the CEO's trying to line their pockets. This Extension is a Temp. fix starting your own business with the skills you have is the best I can say and it will give you 14-20 weeks to do it….if you have an creative idea to start a business call the Small Business Administration they are there to help I will be calling. I am still here. am working on a PC for a customer for my recently started PC repair biz. Those are my skills and Windows 7 is better than Vista but still has issues with drivers for older software. CNN They said it will be signed this morning but the computers need to be reprogrammed….They knew it would happen why were they not prepared?
I will let you know when Little GOP Johnson comes back to play.

I don't understand where people get that unemployment is welfare? First of all you have to have worked in order to be eligible for unemployment. And you can't get it if you were fired. So why call it welfare? You have decent honest hard working people who can't find jobs. Why the insults? I don't get it. What is wrong with human decency for people?
They may be words but you have so many people who are parents, grandparents etc who are out of work and desperately looking for work to keep their family afloat. The last thing I, we, them needs to hear is someones stupid little words. No matter how harmless you think your words are, people are actually suffering right now, and do you think your words make it any better? You don't think we aren't hard enough on ourselves. I'll tell you what, if you people have such great jobs, or own your own businesses, then why don't you step aside and give up your job for 18 months so that someone else can have it. Or start hiring people. Otherwise shut the hell up and get a life.

Calling the Small Business Administration and see if I can get a loan because I dont want to leech off the system. I want to contribute back to society, and I worked for 33 yrs. and had only 2 employers because I am a dedicated and loyal employee, I also write resumes for some friends and when I see 20 different jobs in 5 yrs it makes me want to barf.

melodyk people have to mean when they think they are all that, kudos to them for still having a job and not getting laid off, i bet if they did get laid off the unemployment office is their first call dont let them get to you we all paid into it for many years its ours to claim .a welfare scam to me is keep having babies just so u dont have to work and to get money and foodstamps and a free apt every time the youngest is old enough for school they get pregnant again unemployment benefits are not not not welfare

honey I ve been unemployed longer then that I havent seen a unemployment check since Late Aug eairly Sept when my unemployment Money was all gone so I am in the same boat as U chill you guys need to loosen up hell you might be stuggleing but u need to still enjoy life otherwise you will forget how once you have a job again

We are here striving to survive and keep a roof over our heads and our children fed. We are struggling. I dont have a Phd but it doesnt matter what your skill is, the only one that matters is to survive in these times

just if you go to get loans have a full business plan ready also my best advice is to do something that everyone isnt doing also dont make the mistake that alot of people do is buying all new stuff also did you know to open your own subway franc it cost I think $10,000 of your own money if i remember right when i last saw last year look into it

They do in the south, I have been to the office to get food stamps and have seen many women of different races with handfuls of babies and I bet they cant even remember who the father was of all of them, and I bet each one of those babies has a different father

I know it was a joke buddy but, you had me going for a bit with the veto, and I have a business plan already right now. I have been doing pc repairs for friends in trade for food, cigs, money and beer, gotta have beer to get through these times ya know? and I will make sure I state any money I recieve when my weeks of eligibilty start. I dont want to go to prison and I dont want to be married to the man with the most cigarettes.

Im confused about the 6 week CA unemployed will likey NOT get due to year end filings?? This is what EDD's website says:
On Friday, November 6, 2009, President Obama signed new federal legislation making further unemployment extension benefits available. The first eligible week for the new benefits is the week starting Sunday, November 8, 2009. Any time spent unemployed and without benefits before then is not covered by the new federal legislation.
Although the new extensions do provide the potential for up to 20 additional weeks of benefits for higher unemployment states, including California, it’s likely six weeks of those benefits won’t be available due to pending federal filing deadlines at the end of the year.
The new extensions set new records for benefit weeks available in a federal extension program and will require complex programming to implement. EDD is working around the clock to ensure payments can be made as quickly as possible. It’s currently estimated that will take several weeks.
In the meantime, there is no need to contact EDD. We will be contacting potentially eligible claimants and notifying them of developments. Once programming is in place, we will follow up with further instructions and automatically file the extensions for as many of our clients as possible. We may also need to contact some clients at that time and request further information. Please watch this Web site for further updates.

Did you get your extention?? I was told to apply for a new claim, it would get denied & then the extention would kick in. I did not get an unemployment check this week but was told that it SHOULD be ok next week. Every time I call the unemployment office in ohio, I am on hold for a lengthy time & told something different from each person I have talked to. Hopefully I get a check next week.
