Common Cause: SCOTUS Hearing Tomorrow a ‘Radical Step’

Arn Pearson, vice president for programs at Common Cause and host of a live Web chat on the Supreme Court case being argued tomorrow, Citizens United v. FEC, just noted that the fact that the Supreme Court is even hearing the argument tomorrow is a bad sign for both campaign finance reform and anyone concerned about “judicial activism.”

Responding to a question about what he’d predict the outcome of the case to be, Pearson said:

All we have to go on is a very short Court statement.  Broadening the issue at stake — beyond what the parties argued and the what’s in the factual record  – is a radical step, raising serious concerns about whether the Roberts court will be an activist court and turn its back on principles of stare decisis, or respecting precedent.
