They were seeking a politically acceptable way to say to the world and us that we politicians have not failed. That we politicians did not take our eye off the ball, and we will prevent any future lapses. We politicians are still in charge, and doing a good job, and will solve the problem.</description>

		<description>The fallacy that is causing all the legal trouble here is that we are not legally at war.  &lt;br&gt;&lt;br&gt;War is defined as an armed conflict BETWEEN NATIONS.  Terrorism is a philosophy.  Terror is a noun describing an emotional state.&lt;br&gt;&lt;br&gt;We cannot be at war with a philosophy.   We were duped into a War against Terror, by our politicians.  They were seeking a politically acceptable way to say to the world and us that we politicians have not failed.  That we politicians did not take our eye off the ball, and we will prevent any future lapses.  We politicians are still in charge, and doing a good job, and will solve the problem.&lt;br&gt;&lt;br&gt;If we had said and acted as if the terrorists were/are International criminals similar to pirates the law would have been clear.  When piracy was a bigger problem the law said any nation that met pirates on the high seas had a duty and a right to capture them.  They had the international duty to pursue these criminals and take them home for trial.  They had the right to fight and kill them if necessary.   If we had called these men international criminals we could have pursued them with national and international law enforcement agencies existing in all countries.&lt;br&gt;&lt;br&gt;If we would have investigated, arrested and tried these men in criminal courts around the world we would have accomplished several things:&lt;br&gt;&lt;br&gt;1.  We would not have all the quasis legal courts, prisons, detentions&lt;br&gt;2.  We would probably not have had the US torturing detainees&lt;br&gt;3.  We would have had accepted legal procedures and rules of evidence that applied&lt;br&gt;4.  We would not have US Constitutional abuses involved&lt;br&gt;5.  We would have all the lawful nations around the world united in the effort to stop terrorists&lt;br&gt;6.  We would not have any where near the number of deaths of either the military or the civilians&lt;br&gt;7.  We would not have lost the respect of the world&lt;br&gt;8.  We would not have created a rogue nation doctrine of Preemptive war.&lt;br&gt;9.  We would not be financially broke.&lt;br&gt;10.  We could still say to the world do as I do, whereas now we can only say do as I say.&lt;br&gt;&lt;br&gt;Finally we might have at least paused in this nations continuous policy of perpetual war for perpetual peace.</description>
