The Hidden Bush Dictatorship

Last night on MSNBC’s  “Countdown with Keith Olbermann,” Harper’s writer and lawyer Scott Horton made the astonishing — and very convincing — argument that, while most of us didn’t realize it, over the last eight years President George W. Bush had turned our country into a dictatorship.

Horton, a prominent national security and human rights lawyer, is not on some crazy left-wing rant.  He’s just analyzing the substance of the recently-released Office of Legal Counsel memos.

As we’ve written before, those memos handed the president of the United States extraordinary powers to use the military against U.S. citizens on our own soil, to ignore the Bill of Rights — particularly the First and Fourth Amendments, which are key to basic notions of liberty and freedom from unreasonable government power — and to insulate the executive’s actions from congressional and judicial oversight.

I recently posted an essay, “The Next President,” on my Occasional Dissident site, calling for the Justice Department to take the lead in investigating, prosecuting, and incarcerating those from the Bush administration who violated the Constitution so that we are protected against the temptation for future Presidents to pursue the same dictatorial power. Since then, I have adopted a new motto for the effort: “Let the Constitution have its revenge!” Constitutional due process must be the path to the justice we require. And we do require justice.
