I hope I am wrong, but I think Obama has been seduced by wanting to and being a member of the most exclusive club in the world, i.e. a President of the United States. I think he is afraid that he will be shunned by the group if he advocates prosecuting a former President.

I believe that he is willing to let it happen, but not advocate it. Unfortunately where a real crime is involved that is not sufficient. He will be sorry if he pursues that course as it will haunt him, and probably because he will not refute TOTALLY torture, rendition, spying on Americans etc., he will be as guilty of CRIMES as Bush.

Points very well taken, and I am glad someone is making them.

Ensuring that it doesn't happen again is the most crucial issue, in my opinion. If Obama does not prosecute the criminal behaviors of the utterly lawless outgoing administration, is he not sending the signal, loudly and clearly, to future administrations that they can get away with just about anything once they take office? I will be hugely disappointed, and even angry, if Obama lets this go. I think we should all be angry if the Bush administration is not held to the letter and the spirit of the law of our land.

The impeachment of Clinton was a political prosecution without doubt. The Bush administration is a different species altogether. An independent investigation of Bush administration members' criminal wrongdoings is a duty that should be carried out by the incoming administration if we are to continue as a Constitutional democracy.

There's another reason to investigate (and possibly prosecute) the war crimes of the Bush administration. We are signatories to the Geneva Convention, so how in the world can we expect other nations to take us seriously if we ignore the provisions of that agreement? Why would other nations enter into other sorts of agreements (on trade, military issues, techological ventures) with the United States if it's clear that we can't be trusted to keep our word?
