You have to miss the payments for the bank to agree to the short sell. This really encourage people to do so.
The banks should let the borrowers make the same payments without reset to a higher interest rate for extended period and work on the loan modification such as deferred principal and longer term with a fixed interest rate.
They need to do something to prevent people from walking away from their homes including penalize borrowers who are walking away from their home without trying to negotiate with the bank for a loan modification.
