Some Oil Spill Victims Have Yet to Receive Compensation, Even After Claims Were ‘Escalated’

ProPublica just posted a good story on Gulf oil spill victims who are still waiting to receive compensation for their losses, even after being told by Gulf Coast Claims Facility staff that their claim had been expedited, or “escalated.”
I reported the same thing last week, highlighting the story of Nicole Bolano, a Gulf Coast resident who was told twice that her claim had been escalated, only to continue waiting for payment (ProPublica referred to my item in its story). A handful of other claimants have told me similar stories.
Here’s one powerful example from ProPublica’s story today:
Nick Athens, who filed a claim for lost income from vacation rentals in Destin and Pensacola Beach, Fla., said that he has fallen behind on the mortgage payments for vacation rental properties he owns. In previous years, he used rental income from the spring and summer to cover the mortgage for the rest of year, but this year rentals dropped off following the spill.
Athens has received one check for a fraction of his claim on one property, but the majority of his claim is still pending. He said his case was escalated on Sept. 28 and that he was told he could expect a decision within a week.
On Oct. 7, he had not yet received a response, and he e-mailed Feinberg’s operation to try to speed up the process. “I have until October 16 to make the mortgage payment, after which I risk damage to my credit rating for late payments and possibly going into foreclosure,” Athens wrote.
His claim has still not received a response. “It’s just incredibly, incredibly frustrating,” Athens said.
Kenneth Feinberg, the independent administrator of the GCCF, told ProPublica that escalated claims are “immediately prioritized.” But ProPublica notes, “Feinberg has never promised a specific timeframe for deciding on escalated claims, and he said that the amount of time needed for a decision depends on the contents of the application.”

I heard from a BP person on the phone this morning that Mr. Feinburg have denied all claims for the loss of subconsistences. Why did he have people go submit paper and forms when he had no intension of ever paying?

Claimant Bill of Rights
1. You have the right to equal treatment.
You have the right to be treated with respect, dignity, and fairness, without regard to your race, color, sexual orientation, national origin, religion, gender, or disability.
2. You have the right to equal access to the claims process.
If you have a disability, the Gulf Coast Claims Facility (“GCCF”) will make reasonable accommodations in order for you to access the services of the GCCF.
If you have difficulty communicating in English, the GCCF will provide translation services for you to communicate about the claims process with the GCCF.
If you have difficulty reading or writing, the GCCF will endeavor to explain all documents and forms in a plain and simple manner, and assist you in filing a claim form.
3. You have the right to privacy.
Your submitted personal information will be kept secure by the GCCF and will only be used and disclosed for legitimate purposes in connection with administering the GCCF.
4. You have the right to information about your claim.
You can meet with a member of the GCCF staff to ask any questions you have about the claims process. Once you have filed a claim with the GCCF, you have the right to check the status of that claim by calling the toll-free number (1-800-916-4893 (TTY 1-866-682-1758)), visiting the GCCF's internet site, http://www.GulfCoastClaimsFacility.com, or visiting a GCCF office in person. (A list of site offices is available by phone or on-line.)
5. You have the right to a fair review and determination of your claim.
The GCCF Claims Evaluator will consider all properly submitted evidence that you provide to prove your loss.
6. You have the right to a timely claim decision.
The GCCF will issue a timely determination of your claim. If the GCCF needs additional information in order to decide your claim, the GCCF will notify you in a timely manner of the request for additional information.
7. You have the right to timely payment.
If you qualify for a payment, you will be paid promptly.
8. You have the right to ethical treatment.
All representatives of the GCCF will act ethically and in good faith.

I live in Alabama and due to the economic impact of the oil spill; I was laid off in August. I filed for a 1 month Emergency Advance Payment because I thought it would be easy for me to find another job. After 3 months I still have not been able to find a job.
I spoke to GCCF’s contact person back in September. I was told by GCCF to fill out the Supplemental form on a monthly basis. I was also told by GCCF that the Supplemental forms should not take as long to process. I have since filled out and sent in 3 Emergency Advance Payment Supplemental forms. On October 12, 2010 they actually had my 1st Supplemental form listed as Claimant Paid and Approved for Payment. After changing the status 3 different times online, GCCF finally has it listed as: Claimant has been paid for at least one Claim. This Claim’s Status: Claimants Under Review (Emergency Advance Payment). I also have copies of the Payment Detail Information Sheet, which GCCF no longer puts on their website. This sheet shows 1st time Claimants submitting claims for 6 month payments and being paid ahead of the Supplemental forms that were submitted before them. This is not just for my claim but for anyone who has filed a Supplemental form.
I called the GCCF toll-free helpline AGAIN today. I explained to their contact person, whose name I have on record, that NO where on the Supplemental form does it ask for the county. It does ask for your location which could mean address or city & state. Besides if GCCF cross referenced the Claimant ID # they would see 1 claim has been paid and it lists the county. The contact person I spoke to, for GCCF, told me they themselves have been inquiring with GCCF as to why the Supplemental forms were taking so long to process. GCCF told them they had not even started on the Supplemental forms and could not tell them when they would be starting on them. Tuesday before Thanksgiving is the last day you can file with GCCF for Emergency Advance Payments.

We filed our claim 10/11/2010. We have not received anything as well. Their toll free number tells you to leave a number and time to call and they will call you back. They never do. The same with their email address. Their reps who answer the toll free number give conflicting answers. One will tell you your claim status is updated hourly while another one tells you once a week. Our credit is suffering now and I wonder how many other people's credit is damaged too. Who is going to fix that?

I lost my job when the business I was managing went out of business due to the oil spill. One of my salesman received emergency claim money in about a week, One of my mechanics received money in about a week, another mechanic received 20k the next day after filing his claim, he said he flirted with the girl at the claim center. I “the manager” married and not willing to “flirt” to be compensated fairly have yet to receive any compensation. I feel there’s no rhyme or reason for there disbursements. I’ve spoke with people who work for Sonic for crying out loud who have been compensated. It’s absolutely ridiculous. If anything the restaurants in the area benefited from all the people that flooded this area after the spill. I’m at a lost. I’m considering hiring an attorney although I’ve never sued anyone.
